Terms & Conditions (T&Cs)

1.) Acceptance

By booking a Time Capsule Session or any other other creative service with Jake Ray Winger Storytelling ("we" or "us"), you agree to be bound by these Terms & Conditions.

These Terms & Conditions are available on our website here and will be provided to you as part of the booking process.

2.) Booking & Payment

A signed contract must be agreed upon by both parties before a Time Capsule Session or other creative service can proceed.

Payment:

  • Full payment is required no later than 14 days before the scheduled recording date. We reserve the right to postpone the session until full payment is received.

  • Payment plans are available upon request. Please contact us for details, including deposit amounts, installment schedules, and any associated fees.

We accept credit card, debit card, bank transfer.

All payments must be made in Great British Pounds (GBP).

3.) Cancellation Policy

Cancellation Fees: (Percentage of total of session fee as agreed in contract)

  • Cancellations 14 days+ before the scheduled session: 25%

  • Cancellations between 13 and 7 days before the scheduled session: 50%

  • Cancellations between 6 and 4 days before the scheduled session: 75%

  • Cancellations 3 days (within 72 hours) before the scheduled session: 100%

No-Shows:

  • Failure to attend a scheduled session without prior notification will result in forfeiture of the full session fee. No refunds will be issued.

Rescheduling by Client:

  • More than 14 days before the scheduled session: 25% rescheduling fee (subject to availability).

  • Within 14 days of the scheduled session: Rescheduling is treated as a cancellation, and the applicable cancellation fee (as outlined above) applies.

Travel Expenses:

In the event of a cancellation, we reserve the right to retain any non-refundable expenses already incurred in preparation for the session (e.g., travel bookings, equipment hire), in addition to any applicable cancellation fees.

Rescheduling or Cancellation by Us:

  • In the event of unforeseen circumstances beyond our reasonable control, such as (but not limited to):

    • Natural disasters (e.g., earthquakes, floods, severe weather events)

    • Declared public health emergencies

    • Death or serious illness of the interviewer

    • Significant technical difficulties preventing the session from taking place We reserve the right to reschedule or cancel a session. In such cases, we will provide reasonable notice (wherever possible, at least 24 hours) and offer the following options:

    • Reschedule the session to a mutually convenient time.

    • Provide a full refund of the session fee.

4.) Session Conduct

We aim to create a comfortable and productive interview experience for all clients. To help us achieve this, we ask clients to acknowledge and ensure the following:

It is the client's responsibility to arrive on time for the session booking. Late arrival may result in a shortened session, or if the delay is excessive, cancellation of the session with no refund.

Recording Environment:

  • Lighting: Adequate lighting to ensure clear visibility for the recording.

  • Noise: Minimal background noise to avoid distractions and ensure clear audio recording.

  • Internet Connection (if applicable): A stable internet connection if the interview is conducted remotely, including testing the connection prior to the scheduled start time.

  • Power: Sufficient power outlets for charging and powering any necessary equipment.

  • Parking (if applicable): On-site parking or readily available parking nearby, if the interview is conducted at the client's location.

  • Hygiene: A clean and hygienic setting.

Communication:

  • Please inform us of any special requirements or sensitivities (e.g., accessibility needs, topics to avoid) prior to the interview.

Our Commitment:

  • Clients are under no obligation to answer any question they are uncomfortable with.

  • The interviewer reserves the right to pause or adjust the interview as needed.

  • We reserve the right to terminate a session if the client's behaviour is deemed abusive, disruptive, or inappropriate.

  • Jake Ray Winger Storytelling holds a current Disclosure & Barring Service (DBS) check and Professional Liability Insurance (PLI).

5.) Intellectual Property Rights

  • Copyright of the recorded video and audio materials, as well as any photographs (still images) taken during the session, remains with Jake Ray Winger Storytelling.

  • Clients will receive a high-resolution digital file of the edited interview for non-commercial, personal use, which includes sharing with family and friends, posting on personal (non-commercial) social media accounts, and personal archiving. Any commercial use is strictly prohibited without prior written consent from Jake Ray Winger Storytelling.

  • Clients agree that Jake Ray Winger Storytelling may use short excerpts (e.g., brief audio clips, video clips, still images) from the interview for marketing and promotional purposes, such as website testimonials, social media posts, and promotional videos.

  • Clients may opt-out of this usage by notifying Jake Ray Winger Storytelling in writing prior to any session or booking date. We typically retain the right to use excerpts for marketing purposes indefinitely.

6.) Data Protection

Jake Ray Winger Storytelling will collect and process client data in accordance with applicable data protection laws (e.g., GDPR). Client information will be kept confidential and used only for the purposes of providing our services. For more information, please refer to our Privacy Policy.

7.) Disclaimer

We make no warranties regarding the subjective quality or emotional impact of recordings. Factors like background noise, client location lighting, and client delivery can affect the final product.

8.) Limitation of Liability

Jake Ray Winger Storytelling shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to the provision of our services.

9.) Amendments

Jake Ray Winger Storytelling reserves the right to amend these Terms & Conditions at any time. Any changes will be effective immediately upon posting on our website.

10.) Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales.
